Tang Thomas wins at the Court of Appeal, defeating a challenge against an arbitral award
​
Our Tang Thomas team comprising litigation partners Raj Joshua Thomas and Vigneesh Nainar successfully represented our client in the Court of Appeal case of DEM v DEL.
​
We defended against the appeal to set aside an arbitral award on multiple grounds. The Court of Appeal dismissed the appeal on all grounds submitted by the appellant and awarded costs in favour of our client.
The key point made by the court was that if a party deliberately chose not to attend or participate in an arbitration (despite being aware of it and bein afforded an opportunity to participate), the party may not rely on an alleged absence of notice to challenge the award.

The court also pronounced on what construed proper notice in arbitration, infra petita challenges (challenging the award on the grounds that an essential issue had not been considered by the arbitrator), the judicial approach to arbitration challenges and consideration in contract law.
